Agreement to these terms

RecaPod is a service operated by Famplified LLC. These Terms of Use (“Terms”) govern your access to and use of our websites, applications, APIs, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind that organization.

Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher, and legally capable of entering into these Terms. You may not use the Service if doing so would violate applicable law.

Accounts and capability links

You are responsible for accurate account information and all activity under your account. Keep sign-in credentials and capability URLs confidential. A capability URL acts like a secret key: anyone who has it can use its permissions. Promptly rotate a link or contact us if you believe it has been exposed or misused.

Your content

You retain ownership of content you submit. You give us a limited, non-exclusive, worldwide license to host, copy, transmit, format, and otherwise process that content only as needed to operate, secure, support, and improve the Service and comply with law. This license ends when the content is fully deleted from our systems, subject to retention periods, backups, and legal obligations described in our Privacy Policy and Data Practices.

You represent that you have the rights and permissions needed to submit and process your content. Do not submit regulated, highly sensitive, confidential, or third-party information unless you are authorized and have determined the Service is appropriate for it.

Acceptable use

You may not:

• use the Service unlawfully or to violate another person’s rights;
• upload malicious code, probe for vulnerabilities, bypass access controls, or disrupt the Service;
• access another user’s account, pod, or capability without authorization;
• use automation in a way that imposes unreasonable load or exceeds documented limits; or
• reverse engineer the Service except where applicable law expressly permits it.

Agents and third-party services

You may give a RecaPod capability URL to an AI agent, application, or other third-party service. Those services are not controlled by RecaPod and may have separate terms and privacy practices. You are responsible for choosing them and for the instructions, permissions, and content you provide to them.

Service ownership and feedback

We and our licensors own the Service, including its software, design, branding, and documentation, excluding your content. We grant you a limited, revocable, non-transferable right to use the Service under these Terms. If you provide feedback, you permit us to use it without restriction or compensation.

Availability, changes, and beta features

We may add, modify, suspend, or discontinue features, impose usage limits, or change how the Service operates. We will try to provide reasonable notice when a material change adversely affects active users, but uninterrupted availability is not guaranteed. Preview, beta, or experimental features may be incomplete and may change or end without notice.

Fees, billing, and payment descriptor

If paid features are introduced, the applicable price, billing frequency, and any renewal terms will be disclosed before purchase. Charges for RecaPod will appear on your payment statement as Famplified LLC. If you do not recognize a charge, contact us at info@email.famplified.com.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access when reasonably necessary to protect the Service or others, comply with law, address nonpayment if paid features are introduced, or respond to a material or repeated breach. Terms that by their nature should survive termination will survive.

Exports and backups

RecaPod is a continuity aid, not your sole system of record. You are responsible for maintaining appropriate copies of important content and exporting it before deleting records or ending use of the Service.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or preserve every item of content. We do not warrant the output or behavior of an agent or third-party service connected to RecaPod.

Limitation of liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption, arising from or related to the Service. Our total liability for all claims arising from or related to the Service will not exceed the greater of $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you will defend, indemnify, and hold us harmless from third-party claims, losses, and reasonable expenses arising from your content, misuse of the Service, or violation of these Terms or another person’s rights. This does not apply to the extent a claim results from our unlawful conduct.

General

These Terms and the policies they reference are the entire agreement concerning the Service. If a provision is unenforceable, the rest remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with a reorganization, financing, merger, acquisition, or transfer of the Service. Mandatory consumer protections in your jurisdiction are not limited by these Terms.

Changes and contact
